Abstract

Along with the progress of informationization various laws have been enacted to safeguard personal information and to assure the freedom and rights of information processing entities. But such laws are scattered through individual legislations and have been dichotomized into public and private regulations. In order to reform the confusion in the legal system recent efforts have been made to enact a general law regulating both the public and private areas.
Currently in the 18th session of the national assembly 2 bills on personal information protection falling under general law have been submitted and the「Study on the Legislative Assessment of the Personal Information Protection Law」was conducted to provide data to be utilized in the legislative process through analyzing and evaluating the bills. This survey designed as a part of the study was conducted separately among the general public and professionals.
This data was collected from the general public and the questionnaire includes contents on difficulties in searching personal information protection laws, awareness of the concepts of personal information protection law and the legal system, perception of the realities of personal information protection, need for enacting the integrated personal information protection law, possible dangers in organizations’ handling of personal information and its abuse, degree of invasion of privacy according to types of information collecting, degree of invasion of privacy by CCTV, ownership of personal information, a permissible range of utilization of personal information, state of website memberships, and need for the internet real-name system.
