Abstract

Traffic Offences are crimes of professional negligence committed by ordinary citizens in everyday life with a lesser degree of antisocial propensity, thus it’s sentencing having direct influence on their attitude towards law. Therefore, the sentencing of traffic offences should be carried out more strictly and fairly than general crimes. In spite of its significance, practically no empirical studies are being conduced on the state of sentencing in traffic offence cases. This survey was conducted to provide preliminary data that allows empirical analysis of the state of sentencing through examining the occurrence of traffic offences and the judicial process, based on case records, court records, and ruling decisions on violation cases of the traffic offence exemption law. The questionnaire includes contents on traffic accidents, reason for accident, driver, victim, and circumstances following the offence.
