The special law on sexual violence enacted in 1994 although evaluated as having increased the strictness of punishments against criminals of sexual violence, is being criticized on the other hand for causing the practice of conservative law enforcement on the part of the court due to the possible range of sentencing allowed compared to other crimes. The 「Record Survey on Crimes of Sexual Violence」 was conducted to examine the changes in the tendencies of criminal justice institutions in dealing with and punishing crimes of sexual violence through court records of cases from 1994 to 1998 that have received irrevocable judgments during the first trial. The survey includes contents on type of crime, concurrence, suspect profile, history prior to crime, cause of crime, possible crime triggering elements of victim, attitude of suspect after crime, attitude of victim after crime, and legal processes of criminal justice.
