The「Survey on the Violation of the Rights of the Accused during the Procedure of Criminal Investigation」was conducted by the Korean Institute of Criminology by the request of the National Human Rights Commission of Korea to provide essential data for the establishment of measures for protecting the human rights of the accused by investigating the human rights violations that may be committed by the police or prosecutor during the investigative process such as the failure to notify of the Miranda rule, verbal violence, physical violence, voluntary accompaniment and for the reassessment of the present system and customs. The survey was conducted separately among suspects of criminal cases and the police, and this data was collected from police in detention facilities. The questionnaire is composed of contents on the rights of the accused, the process of arrest and detention, the process of investigation, rights of the accused to medical care, and contents on female and disabled suspects.
